Kostanay businessman was illegally fined for uncleared snow
The Regional Chamber of Entrepreneurs helped him to argue the actions of the police and to cancel the decision in court
LLP “Lombard 555 Credit”, which is managed by Alexander Sloenenikin, the officers of the Office of Internal Affairs visited on 10th of February. The police was not satisfied with the fact that the territory near the building is not cleared of snow, and this is a violation of the Town’s Improvement Rules. For their non-fulfillment, the businessman was charged a fine of 68,070 tenge.
Alexander Sloenenikin was outraged by the actions of law enforcement officers. After all, before that, he regularly cleared the territory. But just on the eve of the visit of policemen, on 8-9 of February, there were strong storms in the region. The entrepreneur at that time was out of town and, because of the bad weather, he could not get to the regional center. When he returned, he immediately took up the shovel. But the Office of Internal Affairs was stern.
"I went to the police, wrote to the prosecutor's office, but no one listened to my arguments. After all, you could have given time, but did not come and immediately write out the protocol. I applied to the Chamber of Entrepreneurs to help me draft a statement of claim in court and to support me at the trial", - says the head of the company Alexander Sloenenikin.
As a result, the court abolished the fine for the absence of the offense. Firstly, because in the Rules for the improvement do not specify specific deadlines for clearing the territory, and secondly, the Chamber managed to prove that the businessman nevertheless removed the snow even before the time of drawing up the protocol
