Commitments of the Republic of Kazakhstan within WTO

The main conditions of Kazakhstan's accession to the WTO is, inter alia, tariff commitments on a number of headings - A list of exemptions, the import rate of which in the WTO is different from the existing customs duties within the EAEU.

Today the list of exceptions consists of 1347 headings (58 commodity groups from all 97 commodity groups in the HS, including agricultural products, textiles, vehicles, etc.), approved by the Council of the Eurasian Economic Commission by the Decision dated by 14th of October 2015 #59 “on the list of goods in respect of which the Republic of Kazakhstan in accordance with the commitments undertaken as a condition of accession to the WTO, the rates of import customs duties, are lower compared to the rates of the EAEU Common customs tariff duties".

In order to prevent re-exportation of goods from the List in the member states of the Eurasian Economic Union after the meeting of the Supreme Council of the Eurasian Economic Union on 16th of October  this year, the Republic of Kazakhstan has committed itself not to allow the export of goods imported to Kazakhstan by the reduced import duties on the territory of other Member States of EAEU.

Rules of the protocol "On some issues of import and circulation of goods on the customs territory of the Eurasian Economic Union" (Decision #22 SEEC dated by 16.10.2015) contain requirements for the declarants, owners and carriers of goods with regard to compliance with the rules of the Protocol and presentation of shipping documents.


In this regard, the Ministry of Finance amended the legal base of the Republic of Kazakhstan, providing for registration of two shipping documents: a customs declaration and the electronic invoice in mutual trade in the framework of the Eurasian Economic Union.

In case the owner is sure that the product will be used only on the territory of Kazakhstan, it is possible to clear of goods at the WTO rates.


In the event that the goods will be exported from the territory of Kazakhstan to the Member States of the Union, it is necessary to customs clear goods at the rate of CCT.

In the field of veterinary and sanitary measures, upon accession to the WTO, Kazakhstan committed itself to apply the requirements that differ from the requirements of regulations of the Eurasian Economic Union in respect of goods subject to veterinary inspection and supervision in accordance with the obligations of the Republic of Kazakhstan as a member of the WTO (13 veterinary certificates of the European Union format - the Republic of Kazakhstan).

Entrepreneurs need to remember that the goods subject to veterinary control (supervision) introduced to the territory of the Republic of Kazakhstan from third countries, and produced from them products can move through the territory of the Customs Union only if the goods imported by the requirements in the field of veterinary sanitary measures of EAEU and the applicable rates of CCT of EAEU.

Rates of import customs duties, lower compared to the rates of the EAEU Common Customs Tariff duties on a list of goods approved by Council Decision number 59, are used since 11th of January  2016.
