In Kostanay a businesswoman lost her building without her knowledge. In search of the truth, she appealed to the Chamber of entrepreneurs and intends to go to the Supreme Court

The story begins in the early years, when an IE "Yemelyanova" learned that she is no longer the owner of an empty two-story building in the city center. Initially, she wanted to restore it, she has delivered construction materials, enclosed the facility with a fence. But then she decided to sell it by placing ads with her contact details. When she appealed again to the Centre for Servicing Population for help, it appeared: "it was decided that the building is not owned by anyone".

This turn of events came as a big shock for a woman. After all, no one informed her about the intention to transfer the building into the municipal property, or about upcoming trials. And, most importantly, allegedly, the attempts to find the businessman lead to nothing.

"There happens a miracle, the owner appears in good health alive. She is a businessman, who is registered with the tax authority. That is you can find all the information if you want? Even the add of the sale contains her mobile number. Nobody even tried to contact her", - said at a briefing at the Chamber of Entrepreneurs of Kostanay region, the lawyer Avelina Morozova, representing the interests of businesswomen.

Arguments that the building is unsanitary, the lawyer denied, by presenting to the city akimat a conclusion of emergency service, together with the rest of the evidence base and the right to legal tenure. Then officials propose to appeal due to newly discovered circumstances.

"Well. We go to the court of appeal, we provide all documents. Even during the debate, Akimat refuses its demands and says: let the court decide at its discretion. But no! The court has other questions: when will you start to build, and in general, what are the plans for this building? What is this for? The owner has the right to dispose her own property", - said Morozova.

The Appeals Board reserves the complaint without satisfaction. As a result, the owner can’t sell or use legally commercial property at her own discretion, the price of which, according to the lawyer, is "not one or ten million tenge".

"Are we going back to the 90s? This leads to only one conclusion, there are people interested in this facility, who want to own that property", - said the lawyer Avelina Morozova.

"Entrepreneur approached us already at the stage of appeal proceedings. Nevertheless, we are now working on this issue and will provide her with maximum assistance in the protection of the legitimate rights ", - summed up at a press briefing, Deputy Director of the Chamber of Entrepreneurs of Kostanai region Samat Sadvakassov.
